President authorizes atomic data sharing with Finland, Sweden under NATO
The determination, effective August 21, 2026, permits U.S. exchange of Restricted and Formerly Restricted Data with Finland and Sweden under the ATOMAL Agreement.
Presidential Determination No. 2026-22, dated August 21, 2026, approves, pursuant to sections 123 and 144 b. of the Atomic Energy Act of 1954, an agreement authorizing the exchange of U.S. Restricted Data or Formerly Restricted Data with the Republic of Finland and the Kingdom of Sweden. The determination directs the Department of War to cooperate with the two NATO members under the Agreement between the Parties to the North Atlantic Treaty for Co-operation Regarding Atomic Information (the "ATOMAL Agreement").
The ATOMAL Agreement, with annexes, entered into force on March 12, 1965 with respect to the United States and the other NATO members at that time. The President notes the recommendation that Finland and Sweden are making substantial and material contributions to mutual defense and security, and that cooperation under the ATOMAL Agreement will further improve the mutual defense posture.
The President determines that the performance of the ATOMAL Agreement, including the proposed communication of Restricted Data and Formerly Restricted Data with the New Parties, will promote, and will not constitute an unreasonable risk to, the common defense and security; approves U.S. implementation of the ATOMAL Agreement with respect to the New Parties; and authorizes the Department of War to cooperate with the New Parties upon satisfaction of the requirements of section 123 of the Atomic Energy Act.
