SEC approves MX2 LLC as sponsor of Joint Industry Options Plan

On August 21, 2026 MX2 LLC filed an amendment to the Joint Industry Plan (the OLPP) to become a Plan Sponsor. The Securities and Exchange Commission issued a notice of filing and immediate effectiveness on August 27, 2026, published in the Federal Register (Vol. 91, No. 168, pages 56249-56250; FR Doc No. 2026-17807; Release No. 34-106210; File No. 4-443).

The amendment adds MX2 as a Sponsor to the OLPP, which already includes sponsors such as BOX, Cboe, Cboe BZX, Cboe C2, Cboe EDGX, MEMX, MIAX, MIAX Emerald, MIAX PEARL, MIAX Sapphire, Nasdaq, Nasdaq BX, Nasdaq GEMX, Nasdaq ISE, Nasdaq MRX, Nasdaq Phlx, NYSE American, NYSE Arca, and OCC. Under Section 7 of the OLPP, an Eligible Exchange may become a Sponsor by executing the plan, providing copies to existing sponsors, and submitting the amendment to the Commission.

The amendment became effective under Rule 608(b)(3)(iii) because the Commission designated it as involving only technical or ministerial matters. The Commission retains authority to abrogate the amendment within sixty days of filing if it deems such action necessary for the public interest, investor protection, or market integrity, per Rule 608(a)(1).

The Commission previously approved MX2's registration as a national securities exchange on March 13, 2025 (Release No. 102650; 90 FR 12590) and approved its proposal to adopt rules for MX2 Options on September 30, 2025 (Release No. 104152; 90 FR 47867). Participation in the OLPP was a condition of that approval.

The Commission is soliciting comments on the amendment. Written submissions must reference File Number 4-443 and be filed by September 22, 2026, either electronically via the Commission's internet comment form or by email, or in paper form sent in triplicate to the Secretary, SEC, Washington, DC. All comments will be posted on the Commission's website.
