IRS submits Section 45J credit information collection for OMB review
Corporations, partnerships and government entities must respond annually to the Section 45J credit request beginning after Oct. 19, 2026.

The Department of the Treasury will submit an information collection request to the Office of Management and Budget for the Section 45J Credit for Production of Electricity from Advanced Nuclear Power Facilities. The request, identified by OMB Control Number 1545-2000, is an extension without change of a currently approved collection.
The collection provides a process for certain taxpayers to obtain an allocation of the unutilized national megawatt capacity limitation (NMCL) under Sec. 45J of the Internal Revenue Code and to transfer the credit. The information gathered will be used to determine the portion of the unutilized NMCL to which a taxpayer is entitled and the potential credit amount.
The affected public includes business or other for-profit organizations and state, local or tribal governments. The notice estimates 80 respondents, each responding annually, with an estimated time per response of 5 hrs., 4 min, for a total annual burden of 406 hours.
Comments must be submitted on or before November 18, 2026. Written comments and recommendations are to be sent within 30 days of publication to www.reginfo.gov/public/do/PRAMain, selecting "Currently under 30-day Review - Open for Public Comments." Copies of the submission may be obtained from Spencer W. Clark by email or phone (202) 927-5331.
The collection authority is cited as 44 U.S.C. 3501 et seq.
