On October 1, 2026, New York Stock Exchange LLC filed a proposed rule change with the Securities and Exchange Commission under file number SR-NYSE-2026-48. The filing, made pursuant to Section 19(b)(1) of the Securities Exchange Act of 1934 and Rule 19b-4, is being published to solicit comments.

The proposal amends Rule 7.18(b)(5)(B)(v) to add the language: "except that an initial listing of an ETP security that is eligible to participate in an IPO Auction pursuant to Rule 7.35(a)(1)(D) will open after 9:30 a.m. ET with an IPO Auction." The Exchange states the change enhances transparency and specificity and is non-substantive because Rule 7.35(a)(1)(D) already requires such an opening.

The Exchange cites Section 6(b)(5) of the Act as the statutory basis, asserting the amendment promotes just and equitable principles of trade and protects investors. It also notes the change does not impose any burden on competition under Section 6(b)(8) and that no written comments were received.

Because the amendment does not significantly affect investor protection, the public interest, or competition, it became effective immediately under Section 19(b)(3)(A)(iii) of the Act. Interested persons may submit comments through the SEC's internet form or by email, referencing file number SR-NYSE-2026-48, on or before November 6, 2026. The Commission may temporarily suspend the rule change within 60 days of filing if deemed necessary.

Sherry R. Haywood, Assistant Secretary, signed the notice, which was filed in the Federal Register on October 15, 2026 (FR Doc 2026-21135).
