President Revises Defense Production Act Delegations to Interior, Energy, Commerce
The order, dated September 8 2026, expands delegated authority to the Secretaries of the Interior, Energy and Commerce and sets new dispute-resolution procedures.

Executive Order 14427, issued September 8, 2026, amends Executive Order 13603 to adjust the delegation of Defense Production Act authorities. The amendment adds the Secretary of the Interior to the list of officials who may exercise delegated authority over all forms of energy, alongside the Secretary of Energy.
Section 201(a)(2) is revised to strike the reference to only the Secretary of Energy and insert language that both the Secretary of the Interior and the Secretary of Energy may exercise such delegated authority independently of the other. The same independent-exercise language is inserted in Section 202(b) for authority over energy production, construction, distribution, use, and directly related activities.
Section 201(d) is modified to replace the final period with a comma and add a clause directing any dispute between the two Secretaries concerning energy to the National Energy Dominance Council for initial resolution. If the dispute implicates national defense infrastructure or military operations, the matter is referred to both the National Energy Dominance Council and the National Security Council, each to coordinate with the Department of War.
Section 203 is rewritten to delegate the President's authorities under section 101(c)(1)-(2) of the Act, 50 U.S.C. App. 2071(c)(1)-(2), to the Secretaries of the Interior, Commerce, and Energy, each capable of exercising the authority independently.
The order states that nothing herein impairs existing statutory authority or the OMB Director's budgetary functions, that implementation is subject to appropriations, and that it creates no enforceable right or benefit. Publication costs are assigned to the Department of the Interior.
