SEC Extends Review Deadline for Nasdaq ISE Digital Commodity Options Rule

On September 21, 2026, the Securities and Exchange Commission designated a longer period for action on Nasdaq ISE, LLC's proposed rule change to amend the criteria for underlying securities. The Commission now requires a decision - approval, disapproval, or initiation of proceedings - by November 11, 2026, rather than the original 45-day deadline of September 27, 2026.

Nasdaq ISE filed the proposed rule change on July 28, 2026 under Section 19(b)(1) of the Securities Exchange Act of 1934 and Rule 19b-4. The filing sought to adopt listing criteria for options on commodity-based trusts that hold one or more digital commodities. The proposal was published for comment in the Federal Register on August 13, 2026, and the Commission received no comments.

Section 19(b)(2) of the Act permits the Commission to extend the standard 45-day review period up to 90 days when appropriate. Citing the need for sufficient time to consider the proposal, the Commission exercised this authority and set the new deadline of November 11, 2026.
