Treasury Issues Interim Rule on State Stablecoin Certification Procedures

State payment stablecoin regulators must follow the new certification forms and procedures beginning Sep. 30, 2026.

The Department of the Treasury, acting for the Stablecoin Certification Review Committee, issued an interim final rule (TREAS-DO-2026-0562; FR Doc No. 2026-19966) that establishes the forms and procedural framework for State certifications under section 4(c) of the Guiding and Establishing National Innovation for U.S. Stablecoins Act (GENIUS Act). The rule is effective September 30, 2026, but certifications will not be accepted until the Paperwork Reduction Act approves the associated information collection; Treasury will announce the acceptance date on its website.

Part 1522 of the interim rule defines the scope, terminology, and severability provisions that govern the Committee's review process. Section 1522.10 outlines the submission mechanics, the required content of initial certifications, and the timing for recertifications. Section 1522.4 reserves the Committee's authority to waive any part of the requirements in exceptional circumstances, consistent with the Act. The rule applies to any State payment stablecoin regulator seeking certification for a qualified issuer whose consolidated outstanding stablecoin issuance does not exceed $10 billion.

Comments on the interim rule must be received on or before November 30, 2026. The Treasury encourages electronic submissions through regulations.gov and requests that comments be captioned "GENIUS Act SCRC Procedures." All comments become part of the public record and are subject to disclosure.
