Cboe Removes Silexx Fees from Exchange Fee Schedule

Cboe's Silexx order-entry system users are bound by contract pricing, not the schedule, effective immediately after the Oct. 15, 2026 filing.

On October 15, 2026 Cboe Exchange, Inc. filed a proposed rule change to delete the Silexx fees from its Fee Schedule. The Securities and Exchange Commission published the filing notice on October 26, 2026 (Release No. 34-106739; File No. SR-CBOE-2026-082; FR Doc No. 2026-22029) and invited comments.

The change is grounded in exemptive relief the Commission granted on May 1, 2026, which relieves the Exchange from the rule-filing requirements of Section 19(b) and the Section 6(b) fee-discrimination obligations for exchange-affiliated order-entry management systems (OEMSs) such as Silexx.

Pursuant to the relief, Cboe proposes to eliminate the Silexx Fee Schedule in its entirety. Going forward, any fees for Silexx will be set in individual contracts rather than posted on the Exchange's website, removing potential confusion between contract pricing and the public schedule.

The exemptive relief conditions require that Silexx use be voluntary, that third-party and exchange-affiliated OEMSs connect on equal terms, that the OEMS not be a broker-dealer, and that fees not consider a user's Exchange activity. The Exchange also must maintain internal controls to prevent any advantage from its affiliation with Silexx.

Because the relief permits the Exchange to forego the Section 6(b) nondiscrimination rules, the removal of the fee schedule is effective immediately upon filing, subject only to any comments the Commission may receive.
