On August 31 2026 Nasdaq filed with the SEC a proposed amendment to Exchange Rule Equity 7, Sections 115 and 130. The filing was published as a notice of immediate effectiveness on September 10 2026 under Section 19(b)(1) of the Exchange Act. The amendment is intended to clarify fees for ports that connect to Nasdaq's Night Session trading environment and to provide fee waivers that facilitate member participation.

Night Session ports are separate from Day Session ports and include FIX Trading, OUCH, CORE FIX, OUCH Purge, FIX Purge and DROP connectivity products. Current fees are $575 per port per month for FIX Trading, OUCH and CORE FIX ports; $500 per port per month for OUCH Purge and FIX Purge ports; and $550 per port per month for DROP ports. The proposal waives the fee for the first five Night Session ports of each type ordered for a member firm (MPID). Beginning with the sixth port of each type, the standard fee set forth in Equity 7, Section 115 will apply.

The amendment also revises the fee for access to the Nasdaq Testing Facility (NTF). Under Equity 7, Section 130(d)(1)(B) the current charge is $300 per port per month for testing services that are not CTCI or FIX interface tests. The proposed change modifies this fee schedule as described in the filing.

Comments on the proposed rule change must be submitted in accordance with the Commission's rules. The filing indicates the fee changes are slated to take effect on September 1 2026, prior to the planned launch of Night Session trading on or about December 6 2026.
