On September 8, 2026, Nasdaq Texas, LLC filed a proposed rule change (File No. SR-NasdaqTX-2026-043) that the SEC is publishing for comment. The filing replaces SR-NasdaqTX-2026-041 and seeks to introduce conforming changes to Nasdaq Texas rules in connection with the establishment of fees for Nasdaq TotalView Plus and Nasdaq Basic Plus.

The amendment would waive external market data distributor fees of $1,620 per month in Equity 7, Section 119 for vendors that certify they will consolidate Nasdaq TotalView, Nasdaq Texas TotalView and Nasdaq PSX TotalView into a feed solely for external redistribution.

It also waives Nasdaq Texas TotalView fees in Equity 7, Section 123 for any firm that purchases Nasdaq TotalView Plus. The waiver includes monthly subscriber fees of $22.25 (operative January 1, 2026) and non-display usage fees of $58.50 per month for each professional subscriber.

For Nasdaq Basic Plus, the proposal clarifies that firms receiving the feed, whether in addition to or in lieu of Nasdaq Last Sale Plus, will pay the same monthly administrative and data consolidation fees currently charged for Nasdaq Last Sale Plus to both internal and external distributors.

The amendments modify Equity 7 Sections 119, 123, 139 and 147 to align Nasdaq Texas's fee schedule with Nasdaq's Equity 7 Sections 123, 132, 139 and 147 for the new TotalView Plus and Basic Plus products, supporting a consolidated data feed schedule slated to begin in December 2026.
