SEC Extends Information Collection for Rule 6e-2 and Form N-6EI-1

The extension applies to separate accounts of life-insurance companies filing Form N-6EI-1, with comments due by Oct. 13, 2026.

The Securities and Exchange Commission has submitted to the Office of Management and Budget a request to extend the proposed collection of information for Rule 6e-2 (17 CFR 270.6e-2) and Form N-6EI-1 (17 CFR 274.301). The request is identified under OMB Control No. 3235-0177.

Rule 6e-2, an exemptive provision of the Investment Company Act of 1940, permits separate accounts established by life-insurance companies to fund certain variable life insurance products to claim an exemption from registration provisions of section 8(a) of the Act, provided they file Form N-6EI-1 as a notification of claim of exemption. The rule also outlines additional disclosure and reporting obligations for those separate accounts that elect to register.

Since 2008, the Commission reports that no separate accounts have filed Form N-6EI-1, resulting in no cost or burden to the industry during that period. The SEC therefore seeks authorization to maintain an inventory of one burden hour for administrative purposes.

The notice reiterates that an agency may not conduct or sponsor a collection of information, and a person is not required to respond, unless the collection displays a currently valid OMB Control Number.
