SEC Extends Review Deadline for Cboe Binary KPI Options Proposal
The extension moves the Commission's decision deadline to Oct. 13, 2026 for Cboe's rule change to list binary options tied to issuers' KPIs.

On August 26, 2026, the Securities and Exchange Commission designated a longer period for action on Cboe Exchange, Inc.'s proposed rule change, File No. SR-CBOE-2026-061, which seeks to amend its rules to permit the listing and trading of binary options overlying key performance indicators reported by certain issuers of stock.
Section 19(b)(2) of the Securities Exchange Act of 1934 allows the Commission to extend the standard 45-day review window to up to 90 days when appropriate. The original 45-day deadline, calculated from the July 15, 2026 publication of the notice, would have been August 29, 2026. The Commission found a longer period necessary to consider the proposal and the issues raised.
Accordingly, the Commission set October 13, 2026, as the date by which it must either approve the rule change, disapprove it, or institute proceedings to determine whether disapproval is warranted.
Comments on the proposal were solicited following the July 15, 2026 notice and are available on the Commission's website at https://www.sec.gov/rules-regulations/public-comments/sr-cboe-2026-061.
The notice was signed by Sherry R. Haywood, Assistant Secretary, and filed as FR Doc 2026-17667 on August 28, 2026.
