NYSE American reduces exam retake waiting periods to align with FINRA
NYSE American members, ETP and ATP holders must follow 15-day and 60-day exam retake periods effective immediately after the Sept. 10, 2026 filing.

On September 10, 2026, NYSE American LLC filed with the Securities and Exchange Commission a proposed amendment to Rule 2.1210 (Registration Requirements). The filing, identified as Release No. 34-106461; File No. SR-NYSEAMER-2026-85 and published in the Federal Register (Vol. 91, No. 185, pp. 61009-61011, FR Doc No. 2026-19635), is effective immediately.
The amendment would change the waiting periods for retaking FINRA qualification examinations. Under the current rule, a first or second failed attempt requires a 30-calendar-day wait, and a third or subsequent failure within two years requires a 180-day wait. The proposal reduces those periods to 15 calendar days for the first and second failures and to 60 calendar days for the third and subsequent failures, matching the recent FINRA Rule 1210 amendment.
The Exchange states that the change is intended to align NYSE American's registration requirements with FINRA's updated standards, thereby promoting consistency and reducing potential confusion for member organizations, Equity Trading Permit (ETP) holders, and American Trading Permit (ATP) holders.
The statutory basis for the rule change is Section 6(b) of the Securities Exchange Act of 1934, including the objectives set forth in Section 6(b)(5) to protect investors and the public interest. The Exchange believes the amendment furthers those objectives by updating waiting periods while preserving the integrity of the qualification program.
