NYSE Arca reduces exam retake waiting periods to align with FINRA
The amendment, filed Sep 10, 2026 (File No. SR-NYSEARCA-2026-96) takes effect immediately, cutting waiting periods for failed qualification exams for NYSE Arca members.

On September 10, 2026 NYSE Arca, Inc. filed a proposed rule change with the Securities and Exchange Commission (Release No. 34-106462; File No. SR-NYSEARCA-2026-96). The notice, published September 22, 2026 in the Federal Register (FR Doc No: 2026-19639), states that the change is effective immediately under Section 19(b)(1) of the Securities Exchange Act of 1934 and Rule 19b-4.
The amendment to NYSE Arca Rule 2.1210 reduces the waiting periods for retaking failed qualification examinations. The period after the first and second failed attempts is shortened from 30 calendar days to 15 calendar days, and the period after the third and subsequent failed attempts within a two-year span is reduced from 180 calendar days to 60 calendar days. These changes are intended to bring NYSE Arca's registration requirements into conformity with FINRA Rule 1210, Supplementary Material .06.
The Exchange cites Section 6(b) of the Act and Section 6(b)(5) as the statutory basis, emphasizing that the alignment promotes a consistent regulatory framework, reduces potential confusion for Members and associated persons, and continues to protect investors and the public interest.
The Commission is publishing the notice to solicit comments from interested persons. The proposed rule change, while immediately effective, remains subject to the standard comment period as provided by the Act and applicable SEC rules.
