NYSE Texas reduces exam retake waiting periods to align with FINRA

The amendment applies to NYSE Texas participants and their associated persons, effective immediately upon filing on Sept. 10, 2026.

On September 10, 2026, NYSE Texas, Inc. filed a proposed rule change with the Securities and Exchange Commission (Release No. 34-106464; File No. SR-NYSETEX-2026-35). The filing, published in the Federal Register on September 22, 2026 (FR Doc No. 2026-19632, Vol. 91, No. 185, pp. 61002-61004), states that the amendment is immediately effective.

The amendment revises NYSE Texas Article 6, Rule 13 (Registration Requirements). It shortens the waiting period after the first and second failed qualification-examination attempts from 30 calendar days to 15 calendar days, and reduces the waiting period after the third and all subsequent failed attempts within a two-year period from 180 calendar days to 60 calendar days. The changes apply to the Securities Industry Essentials (SIE) examination and the representative and principal examinations covered by Article 6, Rule 14.

NYSE Texas explains that the revision is intended to bring its rules into conformity with FINRA's recent amendment to Rule 1210, Supplementary Material .06, which adopted the same shortened waiting periods. Aligning the waiting periods is described as a means to promote consistency, reduce potential confusion for participants and associated persons, and lessen the administrative burden on individuals seeking registration.

The exchange cites authority under Section 6(b) of the Securities Exchange Act of 1934, including Section 6(b)(5), asserting that the amendment furthers the Act's objectives of protecting investors, fostering cooperation with other regulators, and removing impediments to a free and open market.

In its statement on competition, NYSE Texas asserts that the amendment imposes no new obligations or restrictions on participants and therefore does not create an undue burden on competition.
