SEC Extends Information Collection Under Rule 15c2-1

The extension applies to roughly 54 broker-dealers and must be commented on by Nov. 2, 2026.

The Securities and Exchange Commission has submitted to the Office of Management and Budget a request to extend the previously approved information-collection requirement under Rule 15c2-1, 17 CFR 240.15c2-1, pursuant to the Paperwork Reduction Act of 1995.

Rule 15c2-1 prohibits broker-dealers from commingling margin customers' securities with those of the firm or other customers without written consent and bars re-hypothecation beyond the customer's aggregate indebtedness. Respondents must gather the required data, issue and retain notices of hypothecation, and obtain written consents.

Approximately 54 respondents are subject to the rule. Each respondent is estimated to submit 45 responses per year, with each response taking about 0.5 hours, resulting in an industry-wide annual burden of roughly 1,215 hours.

The rule mandates a record-keeping retention period of not less than two years after the notice is submitted. The collection does not involve confidential information, and the OMB control number for the request is 3235-0485.

Comments on the collection request must be submitted by November 2, 2026, via https://www.reginfo.gov/public/do/PRAViewICR?ref_nbr=202607-3235-020 or by email to the address provided. The notice is dated September 29, 2026, and signed by Assistant Secretary Sherry R. Haywood.
