The Securities and Exchange Commission released a notice on Oct. 23 2026 identifying rules scheduled for review under section 610 of the Regulatory Flexibility Act. The Commission seeks public comment on whether each rule should be continued, amended, or rescinded to reduce any significant economic impact on a substantial number of small entities. Comments must be submitted by Nov. 23 2026 and referenced with File Number S7-2026-37.

The list includes the rule titled "Exhibit Hyperlinks and HTML Format," cited at 17 CFR 229.601, 232.11, 232.102, 232.105, 239.40, 249.20f. The rule requires registrants filing registration statements and reports subject to Item 601 of Regulation S-K, or Forms F-10 or 20-F, to provide a hyperlink to each exhibit in the filing's exhibit index and to submit the filings in HTML format.

The rule was adopted on March 1 2017, and the Commission published a Final Regulatory Flexibility Analysis in the adopting releases, Release Nos. 33-10322; 34-80132. An Initial Regulatory Flexibility Analysis was published in the proposing releases, Release Nos. 33-10201; 34-78737 on Sept. 12 2016, and comments received at that time were considered.

The Commission specifically requests comment on whether the rule now affects small businesses in new or different ways than when first adopted. Comments may be submitted electronically via the Commission's internet comment form or email, or by paper to Vanessa A. Countryman, Secretary, at the Commission's Washington, DC address. For further information, contact Sandra Sojka, General Attorney, Office of the General Counsel, at 202-551-4928.

The notice clarifies that the list excludes rules that have been substantially changed since adoption, minor amendments, and rules that are ministerial, procedural, or technical in nature.
