Treasury revises NMTC CDE certification application, opens comment period
The revisions bind existing and prospective community development entities, with comments due by Dec. 29 2026.

The Department of the Treasury's Community Development Financial Institutions Fund announced revisions to the New Markets Tax Credit (NMTC) Program Community Development Entity (CDE) Certification Application. The proposed changes apply to CDEs and entities seeking CDE certification, including for-profit, nonprofit, and State, local and Tribal entities.
The notice specifies four substantive updates: removal of references to "Minority-Owned or Controlled" in describing an applicant's structure; addition of an "Affiliate Information" subsection to capture ownership, control, and foreign interest data; addition of a "Government Investigations and Enforcement" subsection to collect information on investigations and enforcement actions; and expanded language addressing federal anti-discrimination, alignment with Executive Orders, and fraud, waste, and abuse prevention.
Comments must be submitted on or before Dec. 29 2026 to be considered. Submissions are to be made through the Federal eRulemaking Portal at regulations.gov under Docket No. CDFI-2026-0201. For inquiries, the notice lists Shannon McKay, Acting Program Manager for the Office of Certification Policy and Evaluation, as the contact.
The agency estimates the collection will involve 150 respondents annually, each spending about 4 hours, for a total annual burden of 600 hours. The revised application will be filed through the CDFI Fund's Awards Management Information System (AMIS).
The collection is authorized under 26 U.S.C. 45D, 31 U.S.C. 321, and 26 C.F.R. 1.45D-1. The notice appears in the Federal Register Vol. 91, No. 209, pages 68600-68601, FR Doc 2026-22240, filed Oct. 29 2026.
