On September 28, 2026 Cboe EDGA Exchange, Inc. filed a proposed rule change (Release No. 34-106590; File No. SR-CboeEDGA-2026-032) to amend Rule 13.8(d). The filing, published in the Federal Register on October 5, 2026 (Vol. 91, No. 194, pp. 64446-64448), becomes effective immediately under Section 19(b)(3)(A) of the Securities Exchange Act of 1934 and Rule 19b-4(f)(6).

The amendment removes the Last Sale market data feed from the Exchange's rulebook and eliminates all fees associated with that feed. The Exchange notes that execution information provided by the Last Sale Feed is already available through the EDGA Top and EDGA Depth Market Data Feeds, rendering the feed redundant. For internal distributors the removed fees were $0/month for distribution, professional, and non-professional users; for external distributors the fees removed included $0/month distribution, $1.00/month professional, $0.025/month non-professional, $10,000/month enterprise, and $2,500/month digital media enterprise.

The Exchange will announce the specific sunset date for the Last Sale Feed via Exchange Notice within 90 days after the filing date. No comments were solicited or received on the proposal. The Commission may, at any time within 60 days of the filing, temporarily suspend the rule change if it deems such action necessary in the public interest or for investor protection.

The Exchange asserts that the change is consistent with the Act's requirements to prevent fraud, promote equitable trade, and allocate reasonable fees, and it does not impose a significant burden on competition or affect investor protection.
