On September 22, 2026, MX2 LLC filed a proposed rule change (Release No. 34-106479; File No. SR-MX2-2026-08; FR Doc No. 2026-19725) to amend the MX2 Options Fee Schedule. The Securities and Exchange Commission published a notice on September 23, 2026, indicating that the amendment is effective immediately and binds all Members of the Exchange.

The amendment introduces transaction fees and rebates differentiated by transaction type, option class, and liquidity impact. For Customer transactions, the Exchange proposes a Maker rebate of $0.28 per contract and a Taker rebate of $0.48 for Penny options, and a Maker rebate of $0.65 and a Taker rebate of $0.92 for Non-Penny options. For Non-Customer transactions, the proposal sets a Maker fee of $0.50 and a Taker fee of $0.50 for Penny options, and a Maker fee of $0.95 and a Taker fee of $0.94 for Non-Penny options.

Routing fees are also added. Orders routed to other options exchanges will incur a fee of $1.20 per contract for Penny options and $1.63 per contract for Non-Penny options, regardless of the order's capacity.

A Notes and Definitions section is incorporated to consolidate terminology such as "Penny Program Securities," "Away Market Maker," and "Customer," aiming to improve readability of the fee schedule. The Exchange will provide fee qualifiers and codes on monthly invoices to aid members in tracking and reconciling charges.

The Commission is soliciting comments from interested parties on the proposed changes, though the fee schedule will be applied immediately.
