The Securities and Exchange Commission published a notice that NYSE American LLC filed a proposed rule change to amend its Options Fee Schedule, specifically the port fees for Order/Quote Entry ports. The amendment is slated to become effective on September 17, 2026 and binds ATP holders - registered brokers or dealers that hold an American Trading Permit - who connect to the Exchange's trading systems.

The revised fee structure sets the monthly charge at $510 per port for the first 40 ports, $170 per port for ports 41 through 300, $250 per port for ports 301 through 1,000, and $510 per port for any ports exceeding 1,000. These tiers replace the prior uniform rates of $510 for the first 40 ports and $170 for each additional port.

NYSE American argues that the new tiers reflect the finite shared capacity of ports and the incremental infrastructure costs of supporting higher port volumes. The Exchange notes that, even with the added tiers, its fees remain below those charged by comparable options exchanges: Cboe's logical ports range from $750 to $800 per month, PHLX's FIX ports are $650 per month (with SQF ports at $1,185), and Nasdaq's FIX ports are $650 per month.

The filing, identified as Release No. 34-106478; File No. SR-NYSEAMER-2026-87, supersedes a series of withdrawn proposals (SR-NYSEAMER-2026-70, -74, -76, -84). The full text of the proposed rule change is available on NYSE American's website and at its principal office, and the Commission is soliciting comments from interested parties.

The notice was issued on September 23, 2026, pursuant to Section 19(b)(1) of the Securities Exchange Act of 1934 and Rule 19b-4 thereunder.
