On September 18, 2026, The Nasdaq Stock Market LLC filed a proposed rule change (File No. SR-NASDAQ-2026-078) to replace references to its affiliate Nasdaq BX, Inc. with Nasdaq Texas, LLC. The Securities and Exchange Commission designated the amendment operative upon filing, waiving the standard 30-day operative delay under Section 19(b)(3)(A)(iii) of the Act and Rule 19b-4(f)(6).

The amendment makes conforming changes to Options 7 Section 13; Equity 4 Rule 4758; and Equity 7 Sections 118, 130, 139, and 155. Specifically, it replaces one reference in Options 7 Section 13, five references in Equity 4 Rule 4758, twenty-five references in Equity 7 Section 118, one reference in Equity 7 Section 130, five references in Equity 7 Section 139, and one reference in Equity 7 Section 155 with the new name, Nasdaq Texas, LLC.

The Exchange characterizes the change as non-substantive and aimed at preserving clarity and transparency in its rulebook. It cites Section 6(b) and Section 6(b)(5) of the Securities Exchange Act as the statutory basis, noting that accurate naming reduces potential confusion for investors, market participants, and regulators, thereby supporting the orderly operation of a free and open market.

The Commission has opened a comment period that runs until October 26, 2026. Comments may be submitted electronically via the SEC's internet comment form or by email, referencing the file number. The filing and related materials are available on the Nasdaq rulebook website and at the Exchange's principal office.
