FDIC proposes higher threshold for resolution filings by large banks

Insured depository institutions with $50 billion to $100 billion in assets could face new, streamlined resolution filing requirements after the FDIC finalizes the rule.

The Federal Deposit Insurance Corporation issued a notice of proposed rulemaking (RIN 3064-AG21, FR Doc No 2026-13191) to revise 12 CFR part 360. The proposal would raise the dollar threshold that determines applicability from $50 billion to $100 billion and would automatically adjust the threshold over time.

Under the proposal, covered insured depository institutions would submit resolution information focused on data that most directly supports the FDIC's readiness to resolve an institution in distress. The agency would eliminate the credibility assessment of submissions and the current expectations for capabilities testing.

Comments must be received by August 31 2026. Submissions may be made through the FDIC website, by email, or by mail to the address listed in the notice. All comments will be posted publicly, subject to redaction of inappropriate material.

The current rule, effective October 30 2024, requires full resolution plans from institutions with $100 billion or more in assets and limited informational filings from those with at least $50 billion but less than $100 billion. The proposed changes align the applicability threshold with the FDIC's 2025 Thresholds Rule, which indexed thresholds to inflation.
