President Extends National Emergency on Sensitive Tech Advancements
The extension applies to all U.S. investments subject to Executive Order 14105, effective August 9, 2026, for an additional year.

On August 3, 2026, the President issued a notice continuing the national emergency declared under Executive Order 14105, which was originally issued on August 9, 2023. The emergency, invoked under the International Emergency Economic Powers Act, addresses the threat posed by countries of concern advancing sensitive technologies and products critical to their military, intelligence, surveillance, or cyber-enabled capabilities.
The continuation is authorized by section 202(d) of the National Emergencies Act and extends the emergency for one year beyond the original expiration date of August 9, 2026. The notice does not alter the scope of the emergency; it remains focused on U.S. outbound investments that could exacerbate the identified threat.
The notice was published in the Federal Register (Vol. 91, No. 149, pages 50659-50660) and filed as FR Doc 2026-16015 on August 4, 2026, at 11:15 a.m. It will be transmitted to Congress as required by law. The continuation obligates all parties subject to Executive Order 14105 to remain compliant with the restrictions and reporting requirements associated with the emergency.
The President's signature appears on the notice dated August 3, 2026, and the billing code listed is 3395-F4-P.
