SEC grants 24X temporary relief for overnight trading

On August 7, 2026, the Securities and Exchange Commission issued an order (Release No. 34-106061; File No. S7-2026-06) granting 24X National Exchange LLC temporary conditional exemptive relief. The relief becomes effective on January 24, 2027 and remains in force until the earlier of the date the Extended Hours Amendments are implemented or July 2, 2027. It is published in Federal Register Volume 91, Number 156 (Friday, August 14, 2026), pages 52756-52767 (FR Doc No: 2026-16572).

The exemption relieves 24X from certain requirements of Rule 602 of Regulation NMS, from specific obligations under the Joint Self-Regulatory Organization Plan Governing the Collection, Consolidation and Dissemination of Quotation and Transaction Information for Nasdaq-Listed Securities (the UTP Plan) and the Consolidated Quotation Plan (the CQ Plan), and from the Section 19(g)(1) mandate of the Securities Exchange Act of 1934. It allows the exchange to operate its NMS stock trading system during the "24X Market Session" - 9:00 p.m. to 4:00 a.m. Eastern time, Sunday through Thursday - when the exclusive SIPs are not collecting, consolidating, processing, or disseminating consolidated data.

The order conditions the relief on the Equity Data Plans failing to meet the December 6, 2026 implementation date for the Extended Hours Amendments. 24X must make a proprietary real-time data feed publicly available at no cost, provide required disclosures, and submit quarterly data to the Commission, among other safeguards designed to minimize market impact.

24X submitted its request on December 15, 2025, citing the need to trade during the overnight session before the Equity Data Plans could accommodate those hours. The Commission published the application for public comment on February 25, 2026, received comment letters, and considered a response from the exchange dated April 23, 2026.

The Equity Data Plans' amendments, approved on June 26, 2026, extend exclusive SIP operating hours to 23 hours per day, five days per week, with an expected launch on December 6, 2026. The SEC's order therefore provides a conditional bridge, permitting 24X to trade overnight only if those extended-hours capabilities are not in place by the effective date.
