SEC receives exemption request from Eagle Point credit firms
Eagle Point Credit Management LLC and Eagle Point Trinity Senior Secured Lending Co. seek relief effective upon order, with hearing deadline Sept. 11, 2026.

The Securities and Exchange Commission issued a notice of an application filed on April 24, 2026 and amended on July 13, 2026 under Section 6(c) of the Investment Company Act of 1940. Eagle Point Credit Management LLC and Eagle Point Trinity Senior Secured Lending Company request an exemption from Sections 18(a)(2), 18(c), 18(i), and 61(a) of the Act.
The requested exemption would permit certain registered closed-end investment companies that have elected to be regulated as business development companies to issue multiple classes of shares with varying sales loads and asset-based distribution and/or service fees.
The Commission states that an order granting the relief will be issued unless a hearing is ordered. Interested persons may request a hearing by emailing the SEC's Secretary and serving the applicants, with requests due by 5:30 p.m., Eastern time, on September 11, 2026, and must include proof of service.
Requests for hearing notifications and further information may be directed to the SEC's Secretary at the email listed in the notice, or to Trace W. Rakestraw, Senior Special Counsel, at (202) 551-6825. The applicants' counsel is Nauman S. Malik, Esq., c/o Eagle Point Credit Management LLC, Greenwich, CT.
